Re: Community Advice

In my view this can only end in a bad way, on the other hand it may be a good time to clarify what is going on and to clarify the situation before the president leaves their position. This whole situation seems very strange to me and i suspect there is something going on and the president wants out...

Re: Community Advice

The only thing I am wondering is, perhaps there's a suggestion that the "tennant" will stop paying the fees when his mate is no longer the president? If that's the worry, then I can understand why you wouldn't want to take on the presidency - as it will then fall to you to initiate legal ...

Re: Community Advice

Thanx Miro,

now you know the full story, and appreciate your time and comments. I would appreciate further comments from members
with a strong background in community issues, even though I accept my issue is a real odd ball!!

Community Advice

I own a property on a small community of just 6 detached houses. Around 10 years ago one of the British owners disappeared and failed to pay their community charge. The president had keys and unilaterally decided to rent the property to a friend as a permanent holiday home solely to cover the commun...

Re: Recent Application for Residency in Almeria

Hi Both,

thats very helpful, thank you. I am not surprised by this, my solicitors junior here in Mojacar had suggested I start some kind of Spanish savings plan and leave the formal application for a while. From what you both said it looks like I need to find some kind of solution, thanks again.

Recent Application for Residency in Almeria

Hi all, I am reposting this question as my original was not clear and went off subject. I would really like to hear about your experience of applying for residency in the Almeria region if at the time of the application whilst retired in Spain you owned your own house but had no income and were livi...

Re: Applying for Residency

Thanks Sid & Paddy, I should have been clearer, I was referring to CGT on investments, not property. Again, I may have misunderstood the FA in regards to allowances, although as a non earner you would have thought he would have pointed out that I can make a tax free gain as long as its within my...

Re: Applying for Residency

Sid, going off my original subject ( and still waiting for a recent Almeria applicant for Residency without income to reply ) you mention in your last post but one CGT - at a recent meeting with an FA I was informed there is no allowance for CGT in Andalucia?

Re: Applying for Residency

Thank Sid & Paddy, apparently the Almeria office is quite relaxed about health care, Co pay not a problem, they don't mind you not paying a year in advance either. I am informed they won't accept our escritura, and UK bank statements need to be officially " approved and stamped " Its c...

Re: Applying for Tax Residency

No, as I said in my last post, I think all my advisors are guilty of is not correcting me when I asked for their assistance to become " official " tax residents. Both advisors gave me the same list of requirements for Almeria as I mentioned, but clearly for Residency. This is all an irrele...

Re: Applying for Tax Residency

Thanks for all the replies, they confirm to me how things are dealt with so differently from one area to another. I informed both advisors that my wife & I needed to become an "official" tax residents, maybe they did not correct me, saying you mean " Residency " both gave me ...

Re: Applying for Tax Residency

Thanks for those replies. Yes, Spain will become our permenant home. Two different advisors here in Mojacar gave me matching requirements for "tax residency" as a UK passport holder - Residency at the police station is the final process, both informed me this is a fairly simple process. Ho...

Hi, as early retirees and assuming you don't have income, I wonder how you got on with your application for residency?

Applying for Residency

Hi Friends, I wanted to ask members of the forum about their experiences of applying for residency, ideally in the Almeria area. Whilst my wife & I own property in Mojacar, have sufficient cash in a Spanish bank, will have health cover etc, however, we don't tick one important box, we do not hav...

Re: General Tax & Wealth Tax

El Cid, sorry, clearly I should have read your detailed report on tax. It seems as a married couple with no children or dependants our total income from savings interest and draw down or pension payments before tax is payable is 11,000e - This is far less than the 40,000e my Spanish solicitor led me...

Re: General Tax & Wealth Tax

El Cid, super helpful as always, thank you. One final point... yes we earn some interest on cash ISA's etc and assume this along with any other interest is potentially taxable, however, its a small amount, maybe £2000, as a tax resident would I not have a tax free allowance to take of that? You conf...

Re: General Tax & Wealth Tax

Sorry, I wrote the post in a rush just prior to my wife dragging me out the door!! My wife & I are retired here with no income in Spain or UK. We live on tax paid savings drawn from UK bank accounts. Ideally I would like to know as a couple who have no income, like the UK would there be any tax ...

General Tax & Wealth Tax

Hi, My wife & I are overdue becoming tax residents in Andalucia. We own our own house in Spain but have no income or property in the UK, only investment funds and cash savings, we do not draw dividends from funds as they are automatically added to the unit value. Non of this will change for at l...

Legal Implications for other property owners

I own a house on a community of only 6 houses. Some number of years ago the owner of one of the properties died and could not be found ( allegedly ) so the president of our community unilaterally decided after a about a year to have a friend pay of the debts, maintain the property and community fees...

Re: Matriculation Tax - Yachts

Sid, what you say makes sense, my fingers are all crossed as this would leave extra to spend on the boat rather than the tax man!! Thanks, Lee
