English speaking solicitor needed.

I was on here a few weeks ago about being denounced by the community. Our agents who pay our bills on our behalf seem to have been late in paying this bill but are not admitting it is their problem. They are blaming the owners of the builders for sending the account out late. Nevertheless the owners have now taken us to court twice. The second time was this morning. We were notified at mid day yesterday and as we live in England could not get a flight at such short notice. We feel it is time to get some legal advice from an independent lawyer who specialises in civil law. Obviously we do not want this to run in to thousands to take on the community lawyer but feel that it is unjust to be told we have to pay €150-200 when non of this is our fault. I am in the Torre Del Mar area, and any names would be appreciated.

maybe you should pay what you owe rack it up to experience and sack your agent .it is easy to set up a standing order with the administrator(if you have one) for community fees.my experience of the spanish legal system is slow slow slow expensive expensive expensive the only winners in cases such as these are the lawyers

It will cost you far more than €200 to contract a lawyer, procurators, etc. probably with little likelihood of winning. I would rather give €200 to the community than in excess of €2.000 to a bunch of worthless jerks in smart suits.

Arrange to get the bills domiciliado from your spanish bank account (so they are paid automatically and the bank will send you a justificante, receipt to prove it was paid), sack your agents, tell them you want compensation from them and to fill in their complaints book if they don´t reimburse you and write a letter to the community lawyer apologising and absolving you of responsibility. You then write to t e community lawyer yourself and tell them you have made arrangements for it to be paid domiciliado and say you hope it won´t affect relations between yourselves and the community and ask for the explanation to be put on community record......,

OTH, I would NEVER let our administrators have details of my bank account!
There have been too many instances of payments being debited for when they should not have been - duplicates etc.
I think I'm right in saying that in Spain it is generally the responsibility of a debtor to find out/know/ how much is payable and when it is due.
In neither of the communities in which we have lived has it been the practice to actually send out bills!
Many UK owners find this strange and happily wait for bills which never come.

No one seems to send out bills in Spain. We racked up over 2,000 euros in bills from our local builders merchants due to a bit of bad bookkeeping on my part but they still went on selling us things on credit. I wonder how big the bill might have got :shock:
