Recovery of overpaid Spanish CGT!!!!

Article in an Irish newspaper last friday says that a 'leading' Costa Blanca' lawyer has announced that he is confident that he can recover large sums of capital gains tax that have been 'over paid' prior to 1st January 2007 by non residents selling their property and paying CGT at 35%.
His reasoning is that in the preamble to the change in the law to the new reduced 18%, it mentions 'reasons of equality', 'unjustified differentiation' etc, which, in his view, admits that the higher rate previously paid by non residents should not have been in place.

Anyone with any views on this?

One way or another he can't lose can he 8) Lots of punters gonna be paying him at least 6000 euros to take on their case.

paper says its on a 'no win no fee' basis. you sign over 35% of whatever is recovered. he's a veritable charitable institution :shock:

One way of getting lots of publicity and new clients.

This would take years to resolve. I can't see AEAT just rolling over and paying out millions of euros just like that. It will be interesting to see if we hear any more about this.
