The law, or urban myth?

Postby peteroldracer » Sat Nov 04, 2017 8:47 am

Can anyone point me to the exact law that says Residents of Spain are not allowed to drive UK registered cars?
It is one of those “facts” wheeled out time and again, but it would be good to know the letter of the law.
I am well aware that what matters is what a Trafico officer decides is the law that day, at that time......

Hi peteroldracer,

Not found the "law" but came across this.......... from http://europa.eu/youreurope/citizens/ve ... dex_en.htm

"If you're staying in another EU country for less than 6 months and haven't registered your car there, you may not legally lend or rent your car to a resident of that country, who may only drive your car if you are in the car with him/her."
All my best learning experiences start with a problem I need to solve.

They cant drive their own UK registered car after a certain time after acquiring resident permit however they can drive a UK registered car as long as they dont own it and the owner is with them as i understood it .

I always understood that a Spanish resident can’t drive a uk registered car. It does seem a bit bizarre but thats how i read it.

This is what I mean...there are so many “facts” quoted but it is beyond me to find the actual written law.

I'm fairly sure this works the other way round too for a Spanish resident driving a UK plated car in Spain
.

https://www.gov.uk/importing-vehicles-i ... ry-imports

6. Temporary imports

You can usually use a vehicle with foreign number plates without registering or taxing it in the UK if all of the following apply:

you’re visiting and don’t plan to live here
the vehicle is registered and taxed in its home country
you only use the vehicle for up to 6 months in total - this can be a single visit, or several shorter visits over 12 months
HOWEVER If you become a resident or stay for longer than 6 months you must register and tax your vehicle in the UK

That last sentence should end with in Spain, not in the UK - if we're talking about UK vehicles brought to Spain.

Biribiri did say these were the rules in the UK, just presumed they would be the same for Spain.
