Agree with one of the comments,
Being entitled to a tax refund is one thing. Actually getting the Spanish to pay up is likely to be quite another thing entirely.

I know personally of two claims that have been submitted (not by the lawyers mentioned in the article). One was for €26.000 and the other for about €12.000. These have been rejected by AEAT, which is their normal procedure, and have now been presented to the courts. We are awaiting the results.

This has been appearing in various rags all year (or more). Be interested to know how much the money grabbing lawyers are charging to claim this.

I didn't think most people paid this tax anyway :think: They paid the 5% retention and scarpered. Well, not A.commers who are perfect :lolno:

There was a ruling on 6th October this year by the European Court of Justice that the time limit of 2004 could no longer be applied and that claims could go back as far as 1997:

Agree with Beachy, claims have been in for some time, but if I read it correctly, it's only since October that this latest ruling was made. Otherwise I couldn't see the Times, and all other rags, dragging up news that was years old.

I wonder if anyone in the honest Spanish establishment will now declare that forcing people to underdeclare the price at purchase (Eeets de way we ave alhways dooeet senyor) made for bigger CGT payments in a lot of cases, the b*ggers are cheeky enough :think:
