Swimming pools-to fence or not to fence?

Our urbanisation has an unfenced swimming pool.
We have always been under the impression that pools serving 20 or more homes must be fenced.
After our AGM yesterday we are now told that if a pool is licensed for only the season they must be fenced. On the other hand if the pool is licensed for all year roundthe fence is not required by law.
Is this really the case? If so to save the expense of erecting a fence we can apply for an all year use licence.
From a safety point of view this does seem strange.
Perhaps you can give us more information.

Maybe the cost of employing an all-year lifeguard would dampen your enthusiasm for this?

Thankfully, our pool surface area is under the square meterage which requires a lifeguard!

Bearing in mind that our pool is not big enough to require a lifeguard!
Our president was as surprised as we were to be told that a fence is unnecessary if the pool is open all year!!

I think you would be best asking the town hall about the laws.

The current swimming pool regulations, which are a few years old now, do not address the question of fencing.

One of the things that constantly niggles me is that here in Spain it seems impossible to get a 100% certain ruling on what any law is - asking around you can get 7 different opinions, all stated as if that is the law, by any level of person from the tatooed expat barflies to a Junta councillor, so one never really knows what is fact!

Without wishing to sound officious or holier than thou but I do feel that all pools should be fenced and alarmed, there are always toddlers running around our place in the summer and unfortunately some parents are not as vigilant as they should be!

There are no set national laws yet re pool fencing in Spain although of course there may be locally imposed rules. However it is only a matter of time before the French rules (which are currently used as guidelines in Spain and which are quoted by Spanish pool safety equipment manufacturers/suppliers) re fencing, alarms etc etc come into force here so you are only postponing the inevitable if you don't fence...
