Change in CGT for non residents?

Postby Jool » Mon Jun 21, 2010 12:01 pm

Has this changed in the last few years or is there still the annual allowance for increases in value? Is a new multiplier now in use?

The multiplier changes every year and are published in the BOE in December for the coming year.

page 108869

Original purchases prior to 1996 are a little more complicated.

Thanks Beach - the allowances for annual increases in value have not changed though have they, and they also apply to non residents?

Yes it has always applied to residents too.

Is there any chart to work out what CGT we would owe going back to 1999? Not that we have any intention of paying it, just curious

Yes, the coefficients change each year. I take it that is what you mean by annual allowances. I have added the BOE link to my post below. It is a large PDF and will take a while to load.

Katy, there isn't a chart as such. You just work it out for yourself using the coefficients applicable to the original purchase price. If you are fiscal residents you incorporate it in your annual tax return if you don't purchase again within two years but if you aren't then living in Spain you won't be doing a Spanish tax return. Sid knows more about that than I do.

FROM DAVID SEARL

FOR JOOL

If you will obtain the 20th Edition of You and the Law in Spain (and the upcoming UPdate), you will find in Chapter Nine a full discussion of Spanish Capital Gains Tax for residents and non-residents. There are sample calculations for

1. Long-Term Owners, those who bought before December 31, 1986
2. Transitional Sellers, those who bought from 1987 to 1994, with partial rights to the 11.11 per cent reduction per year of ownership.
3. Recent Owners, who have only the inflation correction factor to help them.

The chapter contains the inflation correction factor tables referred to in other posts.

The UPDATE lays out the changes for this year in CGT

Good luck with it, David Searl

Thank you David - so the 2010 edition is the latest full edition and there will not be another one until next year? Is the Update attached with the book or as an additional separate item? Are both available now, if not where and when can I purchase them together please?
