Checking with the Junta de Andalucia

Postby TerryC » Mon Jun 06, 2011 6:29 am

For various reasons my wife and I are thinking of moving to another part of Andalucia, but it is an area plagued by so called illegal properties. does anybody know if there is anyway to check with the Junta whether a property is totally legal or not? I know your lawyer should to do this, but can you trust lawyers any more?

Can you be sure you will get a definitive answer from the Junta?

If there are (and there are supposed to be) properties under investigation, would you be told this? Would they be identified?

I feel, in order to protect their own positions, you would be unlikely to get positive answers either way.

As Julian suggests, you will need a very good lawyer and don't forget to ask him/her specifically about whatever matters concern you and listen carefully to his replies. Ambiguity could become a "get-out" in the event of subsequent disputes. Received wisdom indicates that lawyers in Spain will do what you ask, but will not anticipate problems that you don't raise.

there are many cases where the junta have declared a house illegal when it was not illegal.
the time will come when the junta will have to start paying out damages for those cases.

I can give you the details of the lawyer who works with the AUAN against the Junta abuses and represents home owners in Court if that would help? He knows the system probably better than employees at the Junta.
