Building permissions.

Just got to within 2 days of signing the 10% contract for our legal Casa Rural and the buyers have now decided that they want a guarantee from the town hall that they will be allowed to extend the house by adding a couple more bedrooms onto the single storey ones already there. The footprint will not be increased and there are no near neighbours. We are on non urbanised land and paid compensation to the town hall when we first built the house.

Has anyone else been in a similar situation?

Can a town hall give such a guarantee (I don't think any town hall in any country would give one )

Is there any legal reason for not being able to exend on non urbanised land or is it up to the town hall to decide

Any advice would be very much appreciated.

Bearing in mind that the current regulations do not allow building on rustic land unless the plot is more than 30000m2, it may well depend on the size of the plot.

Even then, when they did allow building prior to 2002 there was a specific ratio of build area to plot area. Where we are it was 1.5%. ie on 10000m2 you can build 150m2 total build area.

There may of course be different rules for a Casa Rural.

The town hall or an architect should be able to advise you on this.

The town hall can not give that certificate..but they can state in writing the present rules in that village for different types of land.It's then up to the buyer to decide if those rules allow what they want to do.

I have no idea, but from a planning point of view they may have different rules.

Correct Sid and here in Extremadura the Junta have just changed the goalposts leaving a few people confused. You cannot now build a Casa Rural within 2km of a population nucleus. I know of at least one person who has an almost completed Casa Rural that will now not be anything other than a private house. I think Andalucia's contagion is travelling north ...
