Adding clause to will

Postby truebrit » Sat Feb 20, 2016 6:23 pm

I have read some of the old postings about this but wonder if anyone has done it recently and what it cost and what they had to do.(this is applying English law to my Spanish Will.)

You cannot add a clause as such. It has to be a new will and will cost the same as the original.

You can make small changes to your will – such as changing the executors or adding a legacy – by using a document called a codicil. A codicil is a straightforward document that needs to be signed and witnessed in the same way as a will.
Google a codicil for more info.
My mother added a codicil to her will. Unfortunately she just signed it " love mum" so legally it was invalid. However, as I was her executor, I was able to agree her wishes with the other beneficiaries and all was completed accordingly.

Not a lawyer but I doubt you can apply English law to a Spanish will, I may be wrong though, I was once before, years ago :)

It is now essential that you say in your will that you wish English law to apply.

I suggest you read this thread.

Thanks for that, I have read various things and it seems that a codicil does not apply here in Spain. I guess it's yet another will. The one I have is already my second! Will get in touch with solicitor and get the wheels in motion.
