Car sale complications

Trying to sell a secondhand car for someone who is non-resident and not likely to travel to Spain again. We have a buyer, but problems with:

ITV, which expired last September. How do we get ITV up to date, when legally it can't be driven anywhere?

Need a copy of seller's passport, no problem.

Need a copy of NIE form. Now we have his NIE number, but no form and he can't remember where it is, or even what it is. Can we apply for a copy, just by quoting the number?

The vehicle will have to be taken to an ITV centre on a trailer. Is it insured?

You can apply for a copy of the NIE certificate but you will need a power of attorney.

You are allowed to drive to the itv centre if you ha be an appointment and drive directly there.

You may also have a problem if he does not have an address in Spain. In Málaga province they may also insist that he has a Padron certificate before they will transfer it to him.

I was once stopped by the guardia when taking my vehicle for a test one day late. It had expired on the previous day, a Sunday. I had a printout of the appointment and a printout of a confirmation email. They said I was breaking the law by driving a vehicle with an expired ITV and the fact that I had an appointment did not make any difference but they did, in fact, let me off with a caution.

Not being someone who takes what these people say at face value I asked a friend who is a Guardia Civil lieutenant and he double checked and confirmed what the traffic officers told me was correct. There is absolutely no provision in the traffic law for driving a vehicle with an expired ITV even with an appointment.

Actually, I think there is a 12% surcharge on the test if it expired more than a month previously.

A friend was stopped on her way to get an ITV (current one expired) and the Guardia said she could continue.

As always in Spain, the law and the interpretation of it are rarely the same!

When i had one that was expired i was told by the gestoria that it had to be grua´d

Even if they have expired i take them anyway with an appointment... its comman sense.. i just hope i dont get pulled over.... :lol:
