BEING SPANISH & GETTING UK PENSION

Postby Unicorn » Tue Nov 20, 2018 12:45 pm

Hi

Does anyone know that if you change your nationality does it affect the UK pension? A pension not being claimed for at the moment, due to start in a while.

Cheers

I’ve always assumed my wife will get a very small pension for the little time she paid UK taxes and NI, even though she’s Spanish and lives back in Spain now.

In short No.

UK state pension is dependant on National Insurance Contributions. You get it regardless of nationality. Non UK citizens who libed and worked in the UK and paid National Insurance have the same right to the pension as a UK citizen.

So your concern is that if you are no longer a .UK citizen will you still be able to claim your UK state pension?

If that is your concern....Then my original answer stands. Citizenship has no effect on UK state pension entitlement.

I would be interested to know why you would do that.

Does the UK/Spain not have a dual nationality deal ?

No, if you take Spanish citizenship, you have to renounce your UK nationality. The UK actually ignore that and you have dual nationality as far as they are concerned, but the Spanish would get seriously upset if you ever used your UK passport in Spain.

So how would that work? I see on the UK government website that you need to be national of the new country before it's possible to denounce UK citizenship.
Would it be possible to tell Spain you are going to give up your UK ine then renegade on that promise and not go through with it?

You can revoke your UK citizenship in the UK, but is not so easy. You revoke it in Spain before a judge as part of the citizenship procedure, but that’s as far as it goes. They don’t take your passport off you.

You have dual citizenship as far as the UK is concerned, but not so in Spain. To use your UK passport or claiming to be a UK citizen is not allowed and is probably an offence.
