how long in spain

after holidaying regularly in our spanish mobile home we have decided to give up work to spend more time in andalucia, but dont want to live there permanantly just yet, the problem is, how long can we stay for?

ha ha yes i know that but i meant are there any legal requirements? i thought you could only spend so many days in spain without having to become a resident

A maximum of 183 days in a 12 month period.

... but if you're here for more than 90 consecutive days you're not classed as a tourist and should register.

Mowser is perfectly correct.
So if you stay for less than 183 days in a 12 month period and there is less than a 90 day continous stay, then you will be OK.

thanks gerry & mowser, so if i do stay more than 3months and i register what does that do to my british status? i will technically be living in spain but stilll have a house in england!! how would that affect things?

Stay 89 days then pop across to Portugal for a couple of nights. I believe the 90 days is continuous. In short - after you've spent a few nights in Portugal (or France) you come back & start the 90 days again.

mmm i had thought about doing that, but what happens after the 2nd 90 day period? presumably i would have to register then

If you don't live here permanently then you won't be able to get the E121 from the UK, that I mentioned on the other thread, so you will only have the limited emergency health cover provided by the EHIC card for tourists and you may well have problems with prescriptions as you are not pensioners.

After the 2nd period you will have been there 180 days and you should register as a resident after 183 days in one period which you would be by nipping over the boarder.

Is it all worth the grief or risk? All said its only a problem or issue if it goes wrong or you get caught and its clear you were trying ot fudge things...... Why do u want to keep your UK status?

i dont know i think i am just scared to take the plunge! i think the best thing is just to take the bull by the horns so to speak and move over there and hopefully everything will fall into place. thanks everyone for all your help

The man at the consulate in Malaga told me that " if you have a British address and are domiciled in Britain there is no time limit on a holiday in Spain".

It is not a problem. Thousands come October to March or April, not just British but Dutch, Germans, Scandinavians. :wtf:

He's absolutely right but you still have to sign on the register of foreigners if you stay for more than 90 days. That is the law.

The Embassy site says:-

From 28 March 2007, Royal Decree 240/07 requires that all EU citizens planning to reside in Spain for more than 3 months should register in person at the Oficina de Extranjeros in their province of residence or at designated Police stations. However, you will no longer be issued with a residence card. Instead you will be issued a Residence Certificate stating your name, address, nationality, NIE number (Número de Identificación Extranjeros) and date of registration.

It's a crazy rule which is why most "tourists" ignore it.
