Are you sure this letter is the real McCoy and not a hoax. Seems a bit amateurish to me. Wouldn't be the first wind up sent to expats.

I can assure you it is a real letter. I received it via my electronic notifications from AEAT, it has a CSV, and appears on my list of notifications on the AEAT web site. Also, the staff at the tax office recognised it immediately.

No ... We are not Spanish Tax residents - Technically we are not UK tax residents either However we elect to pay 'PAYE' on UK pensions

A friend of mine says because he is a non taxpayer only got his state pension paid into His UK bank coming in, he can live in Spain as long as he wants not needing to speak with Spanish tax department, this came about because I thought you could only live here for 183 days a year ???

Just because he doesn't pay tax in the UK on his UK state pensions, it doesn't follow that he would not pay tax on it in Spain if he lives here for most of the time. It depends on the amount of the pension (UK state pensions can vary enormously) and the allowances he gets against it.
Even then, the rules about whether you need to make a tax declaration are complicated and there are fines for not declaring, even if no tax was due.
Recently the Spanish tax office sent out a huge number of letters telling people that they should declare their overseas pensions and that there would be an amnesty on it for a short time if you have previously not declared.
Sadly, there are thousands of UK pensioners who just do not understand the rules and once the amnesty is over they may regret ignoring the warnings.

You can normally stay as long as you like, but if it is more than 183 days in one calendar year you become tax resident.

I understand the tax returns have to be from four years back, regardless of how many years they have lived in Spain
No one mentioned the asset declarations that won't have been submitted.

I do agree that when you get your NIE, or sign on the Foreign citizens Register, you should be given an information sheet Re tax liability in Spain
That way, no one can plead ignorance!
Will all the people who have to make the back payments realise that it's ALL income not just their pensions, eg savings interest etc.
Sometimes we meet people who are adamant they won't pay tax in Spain, they've " chosen" to pay their taxes in the UK. They probably haven't even heard that there is an amnesty
The accountants must be very happy at all the extra work coming their way?

The calculations get a little more complicated next year. I have included the new tax rates but I won't put the other changes in the FAQ yet because I don't want to confuse the issue.

I would just like to relate this story. Someone I know who is a tax resident of Spain has a UK private pension (free of UK tax) which, at the exchange rate for 2014, provides an income for the year of a shade under €14.000,00. He has been told by a widely advertised firm of lawyers/asesores fiscales claiming to specialise in resident taxes for foreigners that he has no tax liability in Spain because his income is below the threshold.
I wonder if these lawyers will pay his fine if and when he gets caught.

I went to one accountant years ago, who said I had no tax to pay
Another said I had several hundred euros to pay
Surely there must be a standard way of working out the tax?

The standard way of working out the tax is to put it through the PADRE program but the problem is the misinterpretation of the tax laws by people who should know better.

The gestor that we used to do our last four years' return initially insisted on doing our 2014 return that the OH's Crown pension must be declared. It took an insistent reaction from me to get him to have a meeting with Hacienda, who seem to have put him right, though he has not yet asked me to go in and complete matters.
In his defence, he does not appear to have many/ any expat clients, and it is possible that none of them have a Crown pension - at least I hope so, or they will have paid tax on it!

Under the new rules you do have to declare it in Spain, though some argue it is this year, and others next year.some say you should always have declared it in the tax exempt box.
Although it continues to be taxed in UK they use it in Spain to work out your tax base with the result that you may end up paying more tax, even though you are not supposed to be taxed twice!
