Upkeep on repossesed property

Postby PavAmber » Tue Feb 28, 2017 7:26 pm

Hi
Not sure if the law section is the right one for this post. Apologies is incorrect mods.

We have a bank repo property next to us that is slowly falling in disrepair. In particular some trees are verging on being a danger (falling) and fences collapsing amongst other problems. We have no idea which bank now "owns" the property.

1. Is there a way of finding out who now owns the property?
2. Can we get them to carry out / do they have a responsibility to carry out basic upkeep and maintenance?

Thanks

Hi PavAmber,
Have a play with Sigpac and see if you can locate the property............

http://sigpac.magrama.es/fega/h5visor/

Tick Parcela box and that will give you the plot number, print out a copy so you can go to Town Hall and enquire.

Here is another way to look.................. http://es.goolzoom.com/

Make a denuncia via your Ayuntamiento. If they agree that the property is in an unacceptable condition and there is a danger from the trees, etc (supply photos to support your case) they will issue an enforcement notice on the owners of the property. As the complainant, you will be given a copy of the notice and it will give a date by which the work has to be carried out, and a fine if it is not done. If the work is not done by the date set out in the notice, you may have to make another denuncia. The Ayuntamiento will have a form for this purpose, or at least ours does. You don't have to specify the owner on the denuncia, just the address, and they will trace who the owner is.

I did this a few years ago regarding a building across the street from my house which had been left empty for some years, and that is what happened. The owner of the building was the Diocese of Málaga and they did do the work following the second denuncia and follow-up enforcement notice.
