Re: Non resident beneficiaries of a will

This all came about when the Ciudadanos/PP coalition wrenched the running of the Junta de Andalucía from the death grip of the PSOE.

Re: occupation license or Habitability license,

I bought my first property in Spain in 1982 and it had been issued with a Cedula de Habitabilidad (the forerunner of the licence of first occupation). I had the rural property in which I currently live built in 1996 and this has an LFO. Even the original old shepherd's cottage built in 1953 has a Ce...

Re: occupation license or Habitability license,

Yes ours similarly although we did not have geological surveys the builder was very knowledgable about the type of land and built the very deep foundations accordingly. MartiD, as long as the walk away clause is watertight it should be OK but make sure you know what is in the contract. Have it trans...

Re: occupation license or Habitability license,

I remembered that there were huge problems with El Capistrano when it was being built in the 1970s/80s I found this article from 1986: https://elpais.com/diario/1986/08/23/espana/525132014_850215.html I has assumed that all its problems would have long been resolved but if they still have no first o...

Re: Non resident beneficiaries of a will

The one million euros allowance and the 99% discount are not the same thing. The allowance does not apply to donations but the discount does. Also, if one exceeds the allowance the 99% discount is applied to the tax on the balance. As far as the third country situation is concerned I posted this a w...

Re: occupation license or Habitability license,

A friend bought an apartment and two garage spaces on a 'luxury' development in Estepona on the promise that a licence of first occupation would be forthcoming at a later date. We advised him not to but he went to a 'prestigious' lawyer in Marbella who convinced him that everything was in order and ...

The CSV is a unique code that gives immediate access to the document to which it refers by entering the number here: https://www2.agenciatributaria.gob.es/wlpl/inwinvoc/es.aeat.dit.adu.eeca.catalogo.vis.VisualizaSc?COMPLETA=NO&ORIGEN=J If, for example, you carry the most recent copy of your non-...

Re: Comments and queries re FAQ for Non-resident income tax

Thanks for the information. This is logical as paying using the digital certificate version of the form depends on linking to the bank account which AEAT cannot do if it is a foreign account (thank goodness!) I cannot confirm whether or not the method you describe will work (maybe someone else can) ...

It all depends on the individual members of staff in any bank but Sabadell has a good reputation amongst foreigners in my area although, personally, I am with Unicaja.

Re: Holiday Let

By the time you have paid the tax which will be 24% with no allowances next year and the electricity for the air conditioning which you must have and are not allowed to restrict, most people I know have decided it is just not worth it.

Re: SMS from Intrum

Mobile numbers are recycled after a period of time. This probably refers to a previous owner of the number. Anyway this type of debt cannot be enforced by a text message. If you really do have a debt they would have to contact you by registered mail.

Re: Comments and queries re FAQ for Non-resident income tax

Hello Zanuck, This is one of the mistranslations I keep on about. This is what it says in Spanish: Si esta autoliquidación es Complementaria de otra autoliquidación anterior correspondiente al mismo concepto, ejercicio y período, indíquelo marcando esta casilla. Declaración complementaria En este ca...

Re: Renta after sale

You cannot do 2020 until 1st January 2021 anyway so I wouldn't bother. If your CGT declaration is negative and you are going to apply for a refund, yes, you will need to submit a non-resident return for 2019. However, as the due date is not until 31st December 2020 I would doubt that they could use ...

Re: Comments and queries re FAQ for Non-resident income tax

Yes, you submit separate tax returns for each property pro-rata.

The declarations are effectively self-assessment. If AEAT decides to check your figures they will be able to do so via the property registry. It is unlikely that the will bother.

Re: Non resident beneficiaries of a will

As always there is conflicting information on this subject from various third party sites but it appears that there is now a 99% discount after applying the formula for calculating the tax due. This only applies to those in groups 1 and 2.

Re: Non resident beneficiaries of a will

Yes. It will be much cheaper and easier than relying on your UK will. It should refer to Spanish assets only.

If it as simple as you say you should be able to arrange this directly with a notary although you may need a translator if the notary does not speak English.

Re: Comments and queries re FAQ for Non-resident income tax

That is certainly what it says in the link I gave but I prefer to take it a year at a time especially where tax rates are concerned. It was only three or four years ago that they changed the tax rate two thirds of the way through a fiscal yeat so who knows what may happen between now and 2022. As I ...
