Re: Residencia. Yes or No ?

Hi Enrique, As far as I am aware it is indeed this green Registro form (your link) that the people I know have got, and for some reason it is very often called Residencia down in the Canary Islands for reasons which have never been clear to me. It is this (to me) flimsy, easy-to-get document (simply...

Re: Residencia. Yes or No ?

Hi All, Firstly, very many thanks to all who have taken the time to reply. My reticence to wait until I am sure is indeed the minimum income requirement. Right now it seems the only financial requirement for Residencia is €6k in a bank account which is bonkers if this document REALLY offers substant...

Residencia. Yes or No ?

Hi All, I'm 50 yo and have owned a property in the Canaries for 7 years. I have an NIE, Spanish bank account, utility bills etc. Over the last 7 years I have spent about 25% of the time in this property and 75% in the UK where I am resident for tax purposes. The longest single stay I have ever spent...

Re: Comments and queries re FAQ for Non-resident income tax

Hi Frank, An excellent post !! Sorry for the late reply. I have been busy with other things so haven't been following this thread. Many thanks indeed for the link to the English instructions. I have already paid for 2016 using the incorrect 2015 VC (ie before the 10% increase) and the 2% multiplier ...

Re: Comments and queries re FAQ for Non-resident income tax

Hi again again, I see from reading pages 53 and 55 of this thread that a couple of other people have also experienced the same as me. Namely their Valor Catastral going up but no indication that this constitutes a revaluation so they must still pay a 2% tax base for income tax purposes. Indeed one p...

Re: Comments and queries re FAQ for Non-resident income tax

Hi again, Regarding my post above, I have now found the website listing Valor Catastral revaluation dates .... http://www.catastro.meh.es/esp/ponencia_valores.asp This website continues to show the Provincia = Las Palmas, Municipio = La Oliva as having a "Ano effecto" = 1994 which agrees with my fri...

Re: Comments and queries re FAQ for Non-resident income tax

Hi Beachcomber and the other very helpful contributors to this board. My municipality is La Oliva which is part of Las Palmas province (Gran Canaria). Thanks to this board I have just paid my fourth annual non-resident income tax on my property. I know what to do to fill out and generate a form and ...

Re: Capital Gains Tax & Residency

So, when a pensioner applies for the >90day registration they either must demonstrate that they have initiated the form S1 transfer of healthcare from the UK or show they have private health insurance ? The reason I ask is that I am certain that the pensioner friends I mentioned earlier in the threa...

Re: Capital Gains Tax & Residency

Thanks again for all the replies. I think the little discussion at the end sort of shows how there seems to be this grey area whereby pensioners can apply for the 90 day Residencia apparently without needing to prove any healthcare provision thus enjoying the benefits of this Residencia without payi...

Re: Capital Gains Tax & Residency

Thanks to everyone for their replies. It seems clear that for Spanish CGT purposes the resident/non-resident distinction is between fully paid up Spanish tax residents versus everybody else and that any notion that being one of these "90 day residents" allows the tax benefits enjoyed by full residen...

Re: Capital Gains Tax & Residency

Many thanks elusive. I see your logic and it would seem to make sense. However, I know of at least one couple who have had Residencia (the over 90 day type) for years with all the associated travel benefits etc but who are not tax residents because they spend less than 183 days per year in Spain. Ma...

Re: Capital Gains Tax & Residency

Thanks Sid. So it is as I expected. Why on earth have they introduced this spurious "Residency" of the first type I mention ? It just adds to confusion so that whenever one sees a point of Spanish law with the word "Resident" in it one is left unsure whether it applies to the first type of residents...

Capital Gains Tax & Residency

Hi All, Firstly, my apologies to the moderators here if this question has been answered already. I have searched but cannot find the answer. I have always understood there to be two forms of Residency. Firstly the type for when one wishes to spend more than 90 consecutive days in the country but les...

Re: Community Questions

Absolutely. You have hit the nail on the head. I am relatively new to Continental Europe let alone Spain and have owned my place there for three years. Over that time I have tried to apply what (rightly or wrongly) I see as a British sense of logic, maturity, democracy and fair-play and have got pre...

Re: Non-Resident Selling a Property & CGT

Thanks again Beachcomber. I had used the full Valor Catastral in the calculator hence the scary numbers coming back at me so many thanks for explaining where I was going wrong. I'll have to dig out an old IBI bill to see what is on there about the land. Is it called anything in particular ? Also, th...

Re: Non-Resident Selling a Property & CGT

Many thanks for the detailed reply and the Plus Valia calculator. Regarding the latter I am amazed it is so much if I am using the calculator correctly. For my Province I get a Plus Valia tax of 1.11% of the Valor Catastral for each year of ownership which over a few years builds into a substantial ...

Re: Non-Resident Selling a Property & CGT

Hi Beachcomber, Sorry I didn't realise you'd done a FAQ. Many thanks indeed for the link. A few questions if I may ... 1) Any idea how the plus-valia is calculated and is this also withheld at the time of sale in much the same way as the 3% retention amount or is it up to the seller to pay this sepa...

Non-Resident Selling a Property & CGT

Hi All, My situation .... Property bought three years ago. After all fees, installation of kitchen and bathroom and fully furnished it has cost €100,000 for which I have receipts. There is no mortgage on the property. Since then I have remained a non-Resident and have paid all my taxes due in Spain....
