Re: Debtors

Thanks very much DS.

That's a relief, the courts are so backed up it is taking four years to get a hearing.

Debtors

Does anyone know whether or not it is true that, if you are pursuing a debtor through the Courts, you can only sue for debts 4 years old and less, no longer than 4 years ?

Thanks, Parilla

Re: How should the cost of re-painting be divided?

Hi beachbabe Am not an expert in these things, just trying to pass on what I and several others in our community have had to try to learn in order to get ourselves out of the horrendous mess we find ourselves in after years of duff presidents and administrators. I'm still sure that the law stipulate...

Re: How should the cost of re-painting be divided?

Not exactly true beachbabe, voting rights are proportional, just as the quotas are. One vote per owner only applies to fulfill the "double majority" requirement of the law.

Re: Statuates of our community... legal ?

Scotty, whatever doubt there may be about the validity of your community, what your president proposes is not legal. Article 7 of the LPH prohibits any alteration in the exterior form of the building, and neither the president nor a majority vote of owners can override this. Glass curtains or whatev...

Re: Rules re: Macro communities

Westend, though my view is obviously influenced by our problems, I think you have hit the nail on the head, in that yes you would have the four presidents of the sub communities as your only representation on the Macro Com, each with a voting right ratio representing the number of homes in their com...

Death

My apologies at the outset for this being not the most cheerful of topics, but whilst neither my wife nor I have any intention of boarding that 'plane for a long long time, we do need to make provision for such an event however far away it is. Our bank accounts are in joint names and I am a bit conc...

Re: Rules re: Macro communities

Agree with Jool, I think you need David on this one. I'm certainly no expert but I understood that a Macro Community could only be comprised of separate communities existing within the developmentit, with the president of each community being the Macro repesentative. If your 100 or so private villas...

Re: Disappearing Debtors

FOR DAVID Thanks David for your reply, which confirmed the situation as I understood it from your book. We don't really have a misunderstanding here, not in the language sense as our spanish is reasonable and the lawyer's english is quite good. The problem is he will not accept what we say or the in...

Disappearing Debtors

A request for some help fro David please. At a recent AGM, the community lawyer was present to advise progress on our ever increasing debtors ( now a total of 100,000 euros !!!!! ). Amongst them were 2 cases where the uk owners live elsewhere in Spain, but it is not known where, and because of this ...

Marble Wall Tiles

Does anyone know the correct cement to fix marble wall tiles ? I have 2 which have "ballooned" off a bathroom wall. They are intact and the surface behind the tiles is sound, but they are large, approx 30cm x 60cm and approx 18mm thick so they are very very heavy. The surrounding tiles all...

Re: Voting at AGM

Not entirely certain, but I think it depends on exactly what the installation you mention concerns, ie whether a qualified majority or a simple majority is required under the LPH to approve this particular addition to the community. If it needs a qualified majority, your president needs approval fro...

Re: safety around the pool

Try www.castillotraductores.com, and in Translation Samples you should find an english translation of the Andalusian Pool Regulations; it's a direct translation from the Spanish, not somebody's doctored version of what they would like it to say ! I think you may only need to go as far as Chapter 1, ...

I'm sure I have read that from the end of this month, at an ITV inspection you will have to produce the vehicle insurance and road tax documents. Anyone else seen that ?

Re: Extraordinary community fees

I think Jool and Paula are quite right, there is no option. However, the decision to undertake the works to the pool, and to levy the additional cuotas must be previously agreed at an AGM or EGM, by a majority of owners.

Not this glass curtaining, Julian. How about less anarchy, some democracy and compliance with the law - maybe this coast would climb out of the hole it has dug itself.

Enclosing of Terraces

Question for David please, on this thorny subject. At our last community meeting, a Spanish owner asked for permission to glass in his terrace - this despite being seemingly against Article 7 of the LPH, and definitely against our community rules. The request was refused by a simple majority. Nevert...
