At the risk of sounding a very rude

The original question was

"Is there any way I can get the hacienda to confirm I am tax resident? Or do I just try again in a few months after I complete my first tax return?"

So from the above replies I assume the answer is ....No...you have to wait and try again in a few months after I complete my Spanish tax return.

I know that is simple...but in the meantime I am out of pocket quite a lot until I can prove that income that I am taxed on in another country (at a much higher rate than here) is taxable in Spain and I should not be subject to the draconian withholding tax I am suffering at source. When I can prove I am resident somewhere else then they will release the tax I paid.

If anyone knows of a method to get the hacienda to issue a cert of residency before I complete my tax return (baring in mind Ihave already have 030 done) I would be very grateful.

I would be amazed if anyone immediately knows the answer to this one (!) - however, if you are a Spanish citizen, own a property in Spain but are a non-resident, could you register a UK plated right hand drive vehicle (the vehicle is a Peugeot 205 cabrio)? Any advice, would be much appreciated, particularly where to begin with the authorities. I could start at the Consulate in London if all else fails. Many thanks.

You mean change a uk plated car onto spanish plates? And the cars in or being brought to spain?. If so then its the same position as a uk with a spanish property holiday home and replating their uk car to use as a run around when in spain.

If your a Spanish citizen surely you have to drive a Spanish plated car wether you are resident or not. You could spanish register the RHD 205 if it has sentimental value.

Hola

A non-resident either has to own a property or have a rental contract to be able to own a car in Spain. the rules were changed in 2005 from memory (when I helped import hundreds of cars).

Re-registering a car is therefore possible

Many thanks everyone for your input. It is for a runaround and I'll look into registering it as pretty sure I couldn't keep it in Spain for any longer than 6 months on UK plates. It pre-dates EU type approval so I think I'll need to talk to an ITV testing station to find out if there's anywhere that does individual homologation.

you dont say where you are Rafael, but the homlogation place is next door to the ITV in malaga guadalhorce.

It's all completely possible but difficult. It all comes down to homolgation....which is expensive and difficult.

However there is a rule about not needing the car homolgated if you are moving to Spain and are bringing the car as a personal possession. Since you are a Spanish citizen maybe you have your DNI with a family home address or similar and could try that.

I imported as part of personal possessions a car that was 18 months old and I lost the will to live even though it was just paperwork I ended up hiring a specialist. The hacienda insisted I had to pay a charge even though I showed them the law that said I didn't..they told me their own website was mistaken. I hired the specialist and had the paperwork done 6 hours later. Total costs for me were 700 EUR and I needed no mechanical work on the car and no homolgation. Also it was an EU registered car, it will be a lot more difficult for your Non EU car.
