New law

Good news for buyers...Local paper reports that from now on estate agents will have to provide (free) an exhaustive technical document/file with all details of the property to be rented or purchased, including, size, quality of building materials, price and way of payment and any debts or duties on the property. ...with fines between 200 and 400.000 for agents who keep silent.

Spain..its a new "decreto" just been approved of by the Junta...does not say more..its in the paper not on line...

Spain is good at passing laws, not so hot on implementing them. They talk a good game! I seem to remember in July/Aug there was going to be a big crackdown on motoring offences, wearing of crash hats etc.. Never saw any difference when we were there last week. :(

The above report is a translation of an article in local paper..I'm only bringing it to attention...as useful info for those who are planning to buy/rent...
now they know that the agent should supply a full report..and can make a demand if this is not full filled.
Hopefully in due time, with the influence of all the new law abiding residents, Spain too, will enjoy, the crime free life, seemingly experienced in other European countries.

el ministerio de vivienda combatirá la especulación del suelo obligando a los promotores inmobiliarios a ceder más superficie a los ayuntamientos cuando los proyectos sean muy lucrativos y menos cuando tengan bajo rendimiento. el borrador de la ley del suelo prevé ampliar la actual horquilla, del 0 al 10% de cesión de suelo a otra del 5% al 15%. la nueva ley también afecta a la valoración del suelo que, de cara a las expropiaciones, se realizará conforme al precio real, no a las expectativas, con el fin de desincentivar la retención de solares sin edificar. el suelo cedido deberá utilizarse para construir vivienda protegida o para usos de interés general como dotaciones. desde algunos ámbitos se critica que esta ampliación de la cesión de suelo a la administración podría tener un efecto rebote sobre el precio de los pisos ya que los promotores podrían repercutir en el precio de las viviendas libres el coste de haber cedido más suelo

Bongtrees No.. the report you posted is something entirely different....it was in the paper Thursday 13th... is not a product of my imagination..perhaps the newspapers are lying.....This law has just been passed, so very soon (not instantly..cos we are in Spain) there should be on line info from the Junta.

You should always wear your crash helmet, no smoking in the airport, speed limit 120 km on motorways, rules for roundabouts ????? etc etc
Rules, yes ! Enforcement ? No

Bongtrees I have lived for 30 years in Spain..my English ain't that great..but good enough to translate...where do you get the information that there is no new law?

LAS INMOBILIARIAS ESTARÁN OBLIGADAS A ENTREGAR A COMPRADORES Y ARRENDADORES UN DOCUMENTO CON DATOS EXHAUSTIVOS DE LA VIVIENDA

El nuevo reglamento de información para la compraventa y alquiler aumenta las garantías de protección al consumidor

Los promotores, intermediarios y arrendatarios de viviendas deberán poner a disposición del público un documento informativo que recoja de forma exhaustiva los datos del inmueble y las condiciones económicas de la oferta. Así se recoge en el reglamento aprobado hoy por el Consejo de Gobierno sobre información al consumidor en la compraventa y alquiler de viviendas.

Respecto a la normativa estatal que actualmente se aplica, el decreto autonómico introduce como principal novedad la obligatoriedad de entregar a los clientes, de forma gratuita, los llamados Documentos Informativos Abreviados (en el caso de primeras ventas y alquileres) y las fichas informativas (para el mercado de segunda mano). En estos documentos se incluyen los datos fundamentales sobre el inmueble y su financiación.

La norma, que refuerza las garantías de protección para compradores e inquilinos, prohíbe expresamente silenciar esos datos, así como proporcionar información que pueda inducir a error al comprador.

El Documento Informativo Abreviado deberá incluir información sobre el intermediario, proyectista o empresa constructora, la fase de ejecución de la obra, el plano de la vivienda y su situación, su superficie útil, la calidad de los materiales y la descripción de sus servicios, así como el precio de venta junto con los gastos y la forma de pago. También se detallarán las cargas que puedan pesar sobre el inmueble y, en función del tipo de venta, se añadirán otros datos legales como la licencia de obras o los datos de inscripción en el Registro de la Propiedad.
Además, se informará al consumidor de que puede pedir una nota informativa sobre la forma de pago con todas las condiciones económicas, incluyendo las relativas a la oferta hipotecaria que se le propone y el tipo de interés aplicable en caso de aplazamientos del precio. Una vez alcanzado el acuerdo de compraventa, la empresa hará llegar al comprador, al menos tres días hábiles antes de la firma, todos los documentos reflejados en el Documento Informativo Abreviado, así como los seguros y licencias del inmueble.

En el caso específico del arrendamiento, el documento recogerá los siguientes datos: identificación del arrendador y del intermediario en su caso, descripción de la vivienda y de los servicios con los que cuenta, superficie útil, condiciones económicas e inventario de enseres y mobiliario.

I watched kids riding scooters up one way streets last week, no crash hats,probably no tax or insurance, mobile in one hand, while the police look on. They're a joke! I often wondered how a lot of these old bangers on the road have passed the ITV, but I was reading last week, that when summoned, I think it was 70% just fail to turn up! Of course, they can be fined, but judging by the numbers not turning up, it would appear very few ever are. Spain has similar rules to UK where are cars and traffic are concerned, the difference being nobody bothers too much about implementing them in Spain.

Fact report by Trafico 44.501 new car registered in Malaga from Jan to August 2005 Sevilla 40.562... 3600 luxury car have bee sold this year...

I think we have to bear in mind that these proposals do not yet constitute the law and having read it the phrase 'coach and horses' springs to mind!

What happens, for example, if the vendor takes out a mortgage or gets an embargo after the agent has written his report. I generally have no sympathy with estate agents but what are they supposed to do, apply for a new nota simple each day until the property is sold. Anyone in their right mind will carry out their own independent checks on the property anyway regardless of what the agent's report says.

This appears to be another brainchild of Manuel Chaves' bunch of merry men who would be better employed getting off their fat backsides and ensuring compliance with the laws that already exist rather that dreaming up more unenforceable legislation.

Similar types of rules also apply to notaries but they get round them by simply writing disclaimers into the escritura which, presumably, is exactly what the estate agents will do in their 'abbreviated informative document' if this nonsense ever becomes law.

Frank - now be fair, a lot of Spanish do wear their crash helmets .... on their elbows which is a very important part of the body to protect you know :lol:

Silver - Traffic Wardens certainly do still issue fines - they also absolutely love their speed cameras here in the UK and you can't get away with no car tax now because you are automatically fined if you do not renew it on time! They love making money out of us car driving brits!

Beachcomber - I would make a comment to you but what you said went completely over my head so best not to :oops:
