Embargoing property for unpaid tax

Postby Jool » Thu Oct 15, 2009 3:39 pm

Please read link below - is it not contrary to EU Law and I would assume Human rights Law for there to be no requirement to advise you personally or prove they had tried to contact you? How many of us have time to read the boletines?

http://www.freefreefreefree.com/Spanish ... rties.html

This is particularly worrying as i have had bank accounts embargoed in the past for alleged unpaid bills, that were in fact paid, and it is apparently sufficient to send a letter to the address on the computer system, regardless of the fact the address may have been fictional, does not and never did exist, and was created by a computer or a functionary to show an address on the system, any one will do it seems. No requirement to prove you signed anything to say that was your actual address etc etc...............

Jool

Sorry to sound thick - can you tell me where I can find these boletines on the net so I can ensure I will still have a home in a month or two's time?

Thanks

You are making my point beautifully, they are far from easy to find so I can´t help, sorry!!!

I think you can google BOP Almeria but whenever I do this and put in my NIE number I get nothing about myself, but I´ve had bank account embargoes!!!!!

You can try here for Malaga Province -
http://www.bopmalaga.org

I expect other provinces have similar sites

It's not just the BOP. You also need to check the BOE and BOJA and, to a lesser extent, the BOPA.

Beach - would you by any chance have links for all these please? Ideally to the very part where you complete your NIE number or name to see if you are a sinner..............I struggle to find the right places on these govt sites..

http://www.boe.es/aeboe/consultas/bases ... anzada.php

http://www.juntadeandalucia.es/boja/buscador/

http://www.parlamentodeandalucia.es/web ... on/bopa.do

You should search on your surname as well as your NIE number and, perhaps, your second Christian name, if you have one, in case it is assumed to be your first surname.

Don't worry too much about the BOPA. This is the boletín of the Andalucían Parliament and doesn't show debtors or offenders.

You may want to check from page 39 to page 50 of BOP number 113 of the 15th June.

http://www.bopmalaga.org/bop_lib/2009/150609113.pdf

There are hundreds of people in Alhaurín el Grande who are named including a large number of foreigners.

If you don't want to check every page just put your surname in the PDF search facility.

I've recently managed to 'miss' a to-be-signed-for communication from the beloved Ayuntamiento...(wouldn't let my PO Box people sign for it and by the time I was able to get the notification, the letter, or whatever it was, had long been sent back from the post office)...and don't know whether to be worried or not :? . I really don't want to stir up any unwanted hornets' nests by going to the Town Hall to try (in my appalling Spanish  ) to find out what it was! All my utilities etc are on direct debit, including IBI etc, and I paid my car tax in April this year (as far as I can remember, that's the only thing they still try and physically send me)........anyone know of anything which has recently been sent out on a general basis......??? Advice please?!

Apologies if this is a silly question but, how does one know if their bank account has an embargo on it? Is it a matter for the bank to let you know?
I´m afraid this embargo business is totally alien to me, another aspect of the oddity of living in Spain I suppose! :?

The bank will send you a slip with the relevant information on it with your statement.

If you have online banking look up the balance, i.e. €500 euros and then look for the amount available. If there is a difference, look up salary retentions. That's how it works for my bank, Unicaja.
