Very interested in purchasing an old house which is without water, electric or sanitation, with a view to having a Solar system, septic tank but mains water. We currently live in the campo and had to get a DAFO before we could repair & maintain this house, it required considerable works to bring it to its current condition, all fine all done. The proposed new house needs even more work & repairs etc ( but not increasing the footprint, it’s a big house) along with installing a kitchen and shower rooms
(we like a project )
Now for my question, we have been told we will need a DAFO but reading up it appears you need services connected, kitchen & Bathroom along with IBI to get the DAFO, the seller will not be interested in getting a DAFO this would be down to us, so can we purchase and do the work applying for DAFO retrospectively ?
Also there is an animal coral attached to the house which we want to put a roof on, can we do this within the same footprint of course.
Helpful replies from experience only please no guesswork, many thanks in advance.

You can purchase without a DAFO.
Purchasing is not the point.
A DAFO (declaracion asimilado fuera de ordinacion) - that's my spelling! - is a process that "regularises" a property built without proper planning consent and that will then allow you to seek permissions for works.
It will not automatically allow you to add a roof over an animal shelter.
You can do any work without a DAFO but you may leave yourself open to prosecution.
Properties without water, sewage disposal or electricity will find it difficult to get a DAFO.
The article by Villas and Fincas (who sold my property for me.....with a DAFO!) is a good summation of the processes.

This is actually a cave house (not our first one) which has been in existence for a very long time and they used the well for water which is now dry, We wouldn’t even buy it until discussions with the Ayuntamiento on what’s allowed, it does appear different areas interpretation of the DAFO is very different!

We found a lovely 2 bed finca, with only 100m of track, for €120,000 but the bank wont sign off on the mortgage for us because it doesnt have an afo. Its been there for 30 or 40 years, and theres probably 20? or 30? other houses on the track and off of little turnings, but this one is on protected land apparently.
