Lawyer to deal with scammers in Viñuela/TdM area
Hi, we have been scammed out of quite a lot of money by a couple of brits who took our money via revolut without providing any invoices and eventualy did barely any work. I spoke to the police, they said it is a civil matter. Can somebody recommend a lawyer who could take this on?

I'm sure, if approached there will be vast numbers of lawyers prepared to take this on, unless it's a lot of money you have to consider whether it's worth it as it will more than likely involve lots of research for which they will happily bill you around 70 euros per hour !Andrey wrote: ↑Wed Aug 17, 2022 5:16 am Hi, we have been scammed out of quite a lot of money by a couple of brits who took our money via revolut without providing any invoices and eventualy did barely any work. I would first get a general consultation with a lawyer specialising in debt recovery and ask how much it's LIKELY to cost.
A friend of mine is currently going through litigation with someone who did a bad renovation on her property and at the moment she has spent more on lawyers fees than the actual renovation, so be very careful.
Maybe you could be a little more forthcoming on the nature of the scam, you'd be surprised at the wealth of knowledge on this forum !
Having said that, revolut is a cowboy banking firm (in my opinion) and I'm guessing they have offered you no help !

Cant you name and shame the trader on here so we can all beware. A lot of forum members will be having work done and would be good to know the scammers.

No, you cannot “name and shame” on this forum. It may be breaking Spanish privacy laws. Any such posts will be deleted immediately.

Even if the police say a it's a civil matter, it is still possible to denounce these guys with the police if they set out to defraud you. However, the issue will be that there are no invoices,
Something similar with a different matter happened to group of parents who paid to send their children to Ireland, but the git ran off with the money the day before they were due to go. All the evidence was there including bank payments, but he didn't issue any invoice so after the investigation nothing could be done,
These guys are doing work without paying their taxes so there might be other ways of leverage to get your money back.

It's a sad thing but in all the time I have been in Spain I only have been cheated once when I lived in Coín and that was by an English 'builder'. In those days I was green and there were no estimates, paperwork of any sort or invoices and I had no 'proof' of anything except my bank account was hundreds and hundreds of pesetas lighter. However, word of mouth flew around the English-speaking community and, one day, he simply left the area. I like to think he upset someone with no scrupulous about inflicting violence and that got his just deserts.

Typical police...you're a foreigner so they don't care.Andrey wrote: ↑Wed Aug 17, 2022 5:16 am Hi, we have been scammed out of quite a lot of money by a couple of brits who took our money via revolut without providing any invoices and eventualy did barely any work. Of course it's a police matter, so get to the Guardia Civil and do a denuncia, although it's better to do the denuncia via a lawyer as clearly the police don't want to do their job! I've been there, had the t-shirt.
In recent times, there are a lot of scammers advertising fake rentals, taking large sums of money from innocent people. The cases I know of have all been dealt with by GC, eventually arresting the culprits, all done via bank account tracing. A spaniard reporting a crime is taken more seriously.

I guess Brits lean towards British speaking people in Spain when it comes to building work, understandable perhaps because of language issues and also because they are out of their comfort zone being out in another country with little understanding of how things work..I guess these facts make them an easier target.

Do you think so? In the case I posted about, it was 20 Spanish people who had been fleeced by an Irish Guy.jhonie99 wrote: ↑Thu Aug 18, 2022 11:40 am

As I posted before, without invoices there is a lack of proof, and this is where the case stalled.
It only becomes a police matter if the guys intentionally wanted to defraud the OP. If not, as in the UK it is a civil matter. My first port of call would be the town hall's consumer service to see if they can help. it doesn't cost anything and maybe if you tell the company who took your money your intention before you go, it might provoke a reaction because it's likely they don't want anyone official poking around their business.

Report them to Revolut; at least it might help stop/slow them down scamming other people.
