legal Aid

Postby Janet Humphreys » Thu Jan 13, 2011 12:59 pm

Is legal aid available to English people living here ? We have resedencia and are in need of a lawyer to help us with a judgement that has been made via our bank over a loan that we are having difficuilty with. The judgement says we have 20 days to appeal.
Just wondered if any one could point me in the right direction l
Thank you

Yes there are legal aid lawyers but unfortunately I can't remember what the spanish term is. I would have thought that they are available to anyone on low or no income who is legally resident in the country.

It depends on your income. You would have to contact the Colegio de Abogados de Málaga, http://www.icamalaga.org/funcio/soj31.htm

Before going down the 'lawyer road' you could consider writing to or telephoning the Banking ombudsman:

Banco de España
Servicio de Reclamaciones
Alcalá, 48
28014 Madrid
Telephone: 901 545 400
Fax: 915379221

http://www.bde.es/servicio/reclama/reclamae.htm

If you write make sure you send the letter by recorded delivery.

There is also a banking association called AUSBANC (Asociacion de Usuarios de Servicios Bancarios) but its web site is only in Spanish and the service is not free:

Let's go Brandon!

A colleague of mine in similar circumstances, obtained a list of legal aid lawyers and voluntary advice centres from the bank itself, obviously aimed at Spanish customers, but maybe worth asking your bank, I believe they are obliged to pass on this type of information...
Also the courts have this type of information available, I believe..
