Confusion about NIE/Residency
Re: Confusion about NIE/Residency
It's on the main coast road in Torre del Mar on the left. It's at the Torrox end of the town shortly after the Supersol / hospital turning roundabout.
Avda. de Andalucía Nº 55 A - 29740, Torre del Mar (Málaga) If you put that into Google you'll get the map spot.

It's on Ave Andalucia, about 200m from the Super Sol on the roundabout going towards the centre of Torre, on the left hand side.Manchesteral wrote:Hi elisive, thanks for that, can you tell me where the national police station is located ? Re: Confusion about NIE/Residency
The year 2014 is certainly significant. I know of two of our friends who had to prove they were non resident for that tax year. Luckily both had been doing non resident tax returns although had signed on the padron (very easy to do here) as advised by their gestors. This could have caused the problem.
Another person I know is keeping his fingers crossed as, he hadn't completed any non-resident tax returns so has put in 3 years worth at one go. He works in UK on seasonal jobs but spends around half of the year in Spain. He pays his taxes in UK and owns a house in Spain and one in UK, so his situation is slightly more complex especially as he isn't sure exactly how many days he has been on Spain each year. I feel he could be in trouble!!
I still know quite a few Brits here who have never registered and are living here permanently, some still with UK registered cars - I find it amazing how they get away with it as it would be so easy for the local police to spot them.
I do everything legal and make a mistake on a tax return having taken advice when I first came here in 2012 and get fined and charged interest. (Just received what is hopefully the last fine today)!!

It's 2014 because anything prior to that is excluded as that's as far back as they are allowed to go.

Re: Confusion about NIE/Residency
As I have said before, (and I say at every opportunity) they nit-pick the registered tax-payers in order to bleed them dry as much as they can but the tax-dodgers just carry on in their own sweet way.
However, they have stated previously that any property owner who is found not to have been paying any tax will be assumed to be a fiscal resident (with all its implications) with the onus being on them to prove otherwise which, as we have seen, is very difficult if there is no history of the submission of non-resident tax returns.
Fyfin, the person who has submitted three years of tax returns can expect fines and surcharges for late payment for any years other than 2018. He would be well advised to ensure that he receives postal deliveries at his address and that there is someone their who can sign for them or obtain a digital certificate.

They sold up in the uk and moved over to spain around sept 2014 and bought a property here a couple of months later. So became tax residents six months later in 2015. They didnt get their residence permit until jan 2015 which makes me wonder if hacienda have picked them out possible thinking that is looks suspicious that they got their residencia at the begining of a new tax year??Beachcomber wrote:If you give exactly the same details as before it should come up with your original number.
Elusive, have your friends been able to produce non-resident tax returns?
But should they have filed a non resident tax form for 2014 as they bought a property in 2014 but didnt become offical residents until 2015?? Maybe thats the connection
Turns out the ppl we know did file a 210 for 2014. Its velez tax office thats wanting payment so they have appealed to head office at malaga via their gestor. So see what happens next

Re: Confusion about NIE/Residency
Hi All, This is my first post on the forum! Glad to be here and of course to be now living in Spain. I have a simple question which is, does anyone know of a Gestoria near Vinuela or Velez Malaga. I have spoken to one or two people and have been surprised to find, shall we say, a certain lack of efficiency and also quite high charges. So, they need to be English speaking, can be working on their own or part of a company. Need to be very responsive, very efficient and yes, reasonable charges. Help would be very much appreciated as my partner and I have just started all the various processes. Interesting time. Keep healthy and as cheerful as possible in these challenging times.
Re: Confusion about NIE/Residency
Welcome to the forum.
For what do you require a Gestoria.
Some specialise in vehicle transfers, some in tax matters, some claim to do it all etc. And some are just rip off merchants charging high fees for something you can easily do yourself.
Cheers

Re: Confusion about NIE/Residency
I think most people who use a Gestoria or Abogado do so because their level of Spanish is not sufficient to get through the mine-field that Spanish bureaucracy can be. ]The information for doing most things is on-line, but problem comes when something goes wrong and bacause of the language barrier you are not sure what it is.

Welcome to the forum in these scary times. Lots of good info on here at the moment and forum is quite busy.

Re: Confusion about NIE/Residency
Hi,
Thank you to those that sent tips and apologies for not replying sooner. Got sorted with a Gestoria in the end and of course, yes, it was because I had lots to do and cannot speak Spanish. Yet! Had good recommendations and have had no problems as yet. Good to have most things now sorted (even TIE) so now is the time to get on with other things. Mind you having just heard about UK banks and their news there may yet be some homework to do on that. I will now be looking at ways of making extra money online to help 'oil the works' so any good tips will be welcome. Take care all. Be safe, happy and well. Brian

I have read in the Latest Euro weekly Newspaper that David Searle says it is obligatory to change your N.I.E Card to a T.I.E card by 31/12/2020 That is not true. What I have read is, if your Present N.I.E Card has been encrypted with "Residente comunitario permanente en Espane desde dd/mm/yy " then this card will exist alongside the new T.I.E. Card after 31/12/2020. You maybe required to change it over at some time in the future.

(quoted from another forum)
Complete nonsense from EWN - I refer all to the following
'It is not mandatory to apply for the new residence document, but it is important to remember that you must have a registration certificate (or family card of a Union citizen, in the case of family members) that documents your situation.'
https://www.lamoncloa.gob.es/lang/en/br ... dence.aspx
'If you registered as a resident before 6 July 2020, you will have a green A4 certificate or credit card-sized piece of paper from Extranjeria or the police. This is still a valid document and will prove your rights under the Withdrawal Agreement, including after the transition period ends.'
