Living in Spain after Dec 31, 2020
I would like to know if a Non-Resident who has been living in Spain for more than 90 day period or 183 day period during 2020, what are the Restrictions for living in Spain from 01/01/2021. Say for instance this person leaves Spain on 15th December 2020 to go UK for Christmas and returns to Spain on 09/01/2020. Would this person now require a Visa to stay in Spain over the 90 day period required by the Laws of Spain in 2021. Any Advise would be appreciated.

Theres no visa to allow you to stay more than 90 days for no reason. There are visas for workers/students but not a general tourist one. If you aren't a legal resident you can only stay in spain or the entire schengen area in the most basic form for 90 consecutive days.then you cant come back for another 90 days. 0r 90 in every 180 in anyway you want aslong as you dont exceed 90 in every 180

Minor rant:
People will soon realise that it is not 90 days in every 180 in one country (e.g. Spain) but 90 days in *any* Schengen country. That means you cannot come to Spain, spend 3 months here and then have a spring ski holiday to France or Italy. It also means you need to bear the mind the days you spend travelling there (i.e. driving through France etc). It really will cause people problems, but that's what we voted for, so our bed is made.
Visas:
There are other ways to get a visa to stay in Spain for longer but they all require quite a bit of legwork and cost.
The "easiest" one is the so-called "non-lucrative visa". This permits you to stay for 1 year BUT you need to prove you are not a burden on the state. Therefore you need proof of access to a minimum €26,000 plus €500 per month for each dependent, and you must also have proof of health insurance cover in Spain (as your EHIC is no longer valid).
There's an approx €80 application fee for this. Google "Spain non-lucrative visa" for more.

I think 90 days in 180 days in Shengen is quite sufficient for most people. I presume there will be stamps in passports and/or passports will be scanned and a cross border Shengen system will sound an alarm in any country if you overstay your welcome in the zone.

It is time for holiday home owners who spend long periods in Spain, usually in the winter months, to realise that this will no longer be possible. It is purely the result of the Brexit vote.
I know many people who are used to winters in Spain who were happy to vote for Brexit.
They will just have to get used to the limitations that have now been imposed on them.

Yes i think you are probably right apart from those who as Sid said like to stay longer over the winter months which would not suit me so yes i can deal with 90 days in 180 quite easily. The only time that would come into question if perhaps OTH retired and if we still had the place then i know he would want to spend as much time there as possible, how that would work i don't know, he would be ok because he is Spanish and our children have Spanish EU passports so they would be ok also.. They will just ignore it and keep coming. Same as the brits here who will keep living under the radar and keep claiming as they still do now that "we still dont know what will happen" eh yeah we do.

They will find that much more difficult with passports being stamped. Get caught and you could be declined entry in future.

The only way I can see living under the radar working is you can never leave Spain. If you do it will be flagged on re entry.
Not many people would want to live like that but always a few for sure.

Yeah thats the only way.but many very rarely go back so are prob like i"ll cross that bridge as and when and hope the police/border guard is half asleep that day!

The problem is for those who are not legal residents. If you are one, there is no problem and the choice to come and go is yours. Should people chose to live under the radar, it will be Ironic really as many people voted to leave because of immigration only for them to become illegal immigrants themselves.

Yes, lots of houses being sold cheap and furnished when its illegal for them to come back to spain
