Recently discovered that neighbours have registered a small area of land with the garage we have been using for 20 years ( and the previous original owners before us) as belong to them on a Newly drawn catastral . It was never on our escritura as we forgot about it! ( yes I know that was stupid) they have begun parking in it, but when challenged spouted b* *beep* about forgetting it was ours. Certainly at this point not declaring it as his... we intend to take some action but not sure what order to do it in. Not sure whether catastral registration can be challenged , or if there’s a time limit, and what role if any does the notary have. We might be able to find witnesses to say that we have had the use of it etc. We just dont know where to begin. As we are trying to sell it need to sort it out somehow. We suspect he will try to charge future owners for it .

You will need a solicitor now otherwise you are wasting your time trying to sell with a dispute hanging over the property.

If someone is changing their catastro plot, an expediente will have been opened for all the boundary properties. Go to the catastro website, enter your details and it should show that an expediente is open, the type of expediente and date opened. Enter the neighbour's details also and see their expediente. Then go to the catastro office and find out what's going on. Thanks for replies. Yes we have a lawyer and yes we have an architect who are hopefully untangling it.
