Thousands of British expats in Spain remain “exposed and unprotected”
Re: Thousands of British expats in Spain remain “exposed and unprotected”
I'm talking about a second property, not our main home. Even with the main home you are exempt if you put the all money into your next residence I understand.

Could you please give a link to the law that states this.

Sorry Beachcomber but it was an article from an official source that i read back in 2015 or 16 as it was relevant to my own personnel circumstances , as i recall the change was confirmed and due to become law within weeks . At the time it was quite a shock for me and i did make enquiries with my accountant who also has a Law degree who confirmed it was correct .

It is just that I have checked with a legal firm in Madrid that specialises in inheritance law and taxes, and with whom I have regular dealings, and they state that the situation has not changed.
I know of someone who is hoping to go through that process in the coming months so I will report back on the result. Meanwhile if you become aware of any further information on the subject I would be grateful if you would share it, by PM if you prefer.

I will look into that again Beachcomber , it could be to my advantage if your right , i would very much like to be wrong even if it means i loose confidence in someone i have trusted for 18 years . If you can report back should you have any further in formation yourself especially if its information gained through actual experience then i would be very interested to know the outcome .

AkoAko, an update as promised.
The escritura for the inheritance as discussed below (unmarried woman inheriting from partner) has been completed. The taxes due, which would have been about €14.000,00, were 'prescrito' (time barred) and I have just received notification from the property registry that the escritura has been inscribed and is ready for collection so it looks as though my contact in Madrid was right.

Meanwhile they were claiming housing benefit and other benefits in the UK. They had the rug pulled out from underneath them through being carless. I know Brexit comes with it's own problems but no one could factor in a pandemic and lockdowns, i imagine people on Uk benefits in Spain who have have got away with screwing the system in both countries may now feel like things are closing in on them from both sides.
I know of someone who had been living here for years under the radar. Then decided to get legal because of brexit. Rang up the uk for their S1 and they were asked how long have you been living in spain. He said something like 15 years. A very short time later he was contacted inregards to the winter fuel allowance he had been claiming for as long as he hadnt been entitled to it. He owed them a large amount of money ontop of fines!
The same person i quoted above has now been found by DWP to have claimed £45,000 worth of disability benefit over the last 15 years that they werent entitled to aswell. All thanks to them asking for their S1. Although they still come out ontop as they are only been forced to pay back 13k of it. £250 a month out of their pension until the debt is cleared. I presume because of statue of limitations. Sounds like a good deal
I guess the next bill will be for his ehic card for the last 15 years!

Oh dear! I guess his plot fell apart when he said 15yrs...He must have failed to remember that he would have been submitting a Uk address for ethic cards and other claims..Smart but not smart enough.
