I love Mentón. When we spent 5 years sailing around the Med 20 years ago, we stopped there. Loved it. A mixture of France and Italy..

Before lockdown I visted Menton on an annual basis to pay my respects to William Webb Ellis who is buried there, not been for 2 years and doubt I will make it this year !

A friend of mine, who is a non-resident , traveled to Scotland on 17th July 2021 in order to have her double jabs done by NHS in UK. Her Passport was stamped going out from Malaga Airport on 17th July 2021. Does she have to stay away for a full 90 days or can she return to Spain and have her Passport stamped again. Then only does her 90 day stay in Spain start. My friend was living in Spain on 31st December 2020.
Can anyone explain this particular scenario to me.

Well technically she was illegal in July because as a non resident she should have left Spain by 31st March, 90 days after Brexit. To be safe she should not re enter Spain until 17 October. She can then stay to 17 January, then leave until 17 April. All dates approx as I have used 3 months not 90 days.

Hola

Quite simply, it is a ROLLING 180 days within which, you can spend 90 in the Schengen area.

Today is day 180, yesterday is day 179 etc. So count 180 days back and how many days have you spent in the Schengen area? If less than 90 days then you can travel, if more then you can't travel

If she has already been in spain for more than 90 days which if you are saying she has been in spain continually since the end of the year 2020, then yes she has to stay away for another 90 continuas days. She has already over stayed illegally as shes been in the country 7 months continually.

Whether it gets flagged is another issue as shes only got one stamp in her passport although they are scanned aswell. The problem is when you keep going back and forth and stamps are checked and passport scans are flagged up

Does anyone know of or heard of an "extension visa" which allows a late applicant for residencia to overstay whilst having their application monitored/processed ?

An aquaintence of mine is now, belatedly wrestling with this problem !!

If you have applied for residency under the W.A then you can stay until the process is finished. If its denied you can stay until the appeal is completed..

The only visa extension that excists at the moment is for non residents who need to overstay in extenuating circumstances such as resident family members with ill heath etc
