90 day rule

With regard to the question of non EU spouses travelling with their EU spouses, it has been suggested that the 90 day rule does not apply if they are travelling together.

Does anyone have a reliable source of information to confirm or deny this?

Sorry, but I cannot see any definitive evidence in that mess of Facebook posts. I want to see a definitive statement from a significant EU source that confirms that it is possible in a form that would be acceptable to border control officials.

It’s not about right of residence, it is freedom of movement that is the issue here.

My understanding is that that I can spend more than 90 days in 180 as long as I am travelling with my wife. There has been some confusion over this but I read this a few weeks ago which seems to confirm it.

Sid, i understand what you are asking and the only way to find out what evidence would be needed is to contact the consulate to be certain... I have recently travelled with OTH twice and did not make them aware that we were travelling together because we are not intending to be in Europe for more than 90 in 180 during the next year or two so i have no idea what would be requested. The info which i read seemed to indicate proof of marriage/ birth certificate etc.Perhaps airline booking proving travel with Spouse... If and when we do intend to stretch the 90/180 rule then OTH would contact the consulate where he is registered here in the Uk for clarification on what evidence is required...Registration is not required and so far they have always been prompt with replies although quite often the reply is a link leading to the information required. Perhaps give it a go. :)

If you are referring to the post at the top of the page by Simon Walshe, that refers to the residency rules, not the question I asked.The other posts suggest that it may be possible to travel with your EU spouse, but I am looking for a definitive answer from a reliable source.

Thanks Mark. That's a good explanation, and the original advice was from a reliable source, rather than just a CAB opinion.

Further down it gives info inregards to traveling over 90 days with a non e.u spouse. Marks link has sorted it anyway.

It highlights one of the many flaws with FB in that you can only link to a whole thread, not to an individual post. Compared to using a proper forum it’s just a joke.

Does anyone know of a "good" app for recording my visits and telling me my 90 day situation? Also do we have any info. what happens if you go a day or two over?

Well, the app didn't work properly for me, neither did the europa. EU one. The schengenvisainfo one is great but can't save it.

Assuming Windows.......

With the results on your screen use the Windows "Snipping Tool" or "Snip and Sketch" to save as a file.......... :idea:

OR

Prt Scrn (Print Screen ) from your Keyboard. ........ or simply Ctrl + P

Other OS's (Operating Systsems) will have similar Tools.

I'm looking for an application that will save past periods in the Schengen area and allows me to put in further dates to see if it is allowed. I will be sailing close to the wind and don't want to either end up in a Spanish jail or banned from entry. As said the Schengenvisainfo is great but have to input all dates again whenever I use it

Isnt the easiest way just to count 180 days ahead from the first day you step into a schengen area. Mark day 180 in a diary and then make sure you dont stay more than 90 days upto the 180th day marked down?
