It is now official. Wealth tax has been abolished for both residents and non-residents:

However, don't forget that non-residents still have to complete a notional income tax return based on the valor catastral (rateable value) of their property as well as income tax on any actual rental income.

Wealth tax has been abolished as from 1st January 2008 so the last declaration was the the one for the fiscal year of 2007 for which the deadline was 31st December 2008.
This year, 2009, you will only need to declare for non-resident income tax for the fiscal year of 2008. Whether the declaration will be on a revamped form 214 or a completely different one I hope to find out tomorrow (Thursday) when I have to go to the AEAT office in Málaga.

Re: Wealth tax - Patrimonio
Not much joy in the tax office this morning. 'Information' told me to go and ask 'the man who sells the forms'. The man who sells the forms wanted to sell me an old style form 214 and didn't even know that patrimonio had been abolished.
He asked me when the information in the BOE had been published and when I told him it was the 25th December he looked aghast and said that it would be a few months before any new forms (if there were to be any) would be available. Information on the AEAT web site has not been updated and still refere to the payment of wealth tax.
I suppose we shall have to wait until someone at AEAT puts down their cup of coffee and their newspaper and decides what to do.

So if you have a property in Spain that you do not rent out, why do you need to fill out a form for income tax when thats done back here in England?

Because that's what the Spanish law says you must do. Sorry, I can't give you any other reason.
