I'm unsure. Before PP got in, it wasn't an offence in Spain to share files. Morally wrong I grant you, but it wasn't illegal.
P2P File-Sharing legal in Spain

Spain is becoming the last bastion of common sense when it comes to peer-to-peer and file sharing, at least until the big media companies get their own way and change the law in the country altogether. Torrentfreak, the ever-vigilant blog focusing on BitTorrent and file-sharing issues, points to a recent lawsuit in Spain that ended quite favorably for both P2P users and link sites and dedicated search engines, and that found both use-cases to be perfectly legal in the country. In the country, file-sharing is pretty much legal, as long as there aren't any financial benefits for either party. This also weighed in on the judge's decision, as this site didn't have any advertising or any other form of revenue directly related to linking to the files. The judge not only declared these types of sites to be legal, but he also reiterated that individual users' downloading copyrighted material from P2P networks for non-profit reasons was also legal in Spain.

They passed the Ley de Sinde on December 30th so it is now illegal in Spain.

I thought the law only closed down web pages offering pirated films.

That's right but's that's about all they can do anyway. Actually using pirated material is not an offence.

As The Pirate Bay is based in Sweden presumably it is not an offence to download files in Spain.

My grandad too! My sister has a door stop made of carved wood with a horse shoe from grandad horse. Sadly our grandad died before we were born, so we never knew him. The horse shoe is worth more than money can ever buy!
