Buying Land?!?!

Following a recent search for some land in Andalucia I have become very disillusioned with the whole effort.

Agents who suddenly decide that the pirce has gone up when you show interest, owners who lie about exactly what they own etc etc

The last land we saw was 41,000m2 and just about perfect for our needs. No agents involved which was a blessing! Had a meeting with the guy and he bought along all of the paperwork which was a result. turned out to be 2 pieces of land which is fine. One piece was great and the paperwork was perfect. The other piece had a few queries. Went to the solicitor and they recommended obtaining a supplementary Nota Simple.

Good job we did!! The piece of land had 59 other owners!!!

There was no mention of this at the meeting.

Do the Spanish think we are stupid or something?? Do estate agents think that the English leave their brains in England when they come over??

Hi,

You need to be careful buying rustic land with a view to building on it. The laws have really tightened up and the old 10,000 metres and you can build days have gone. Did the land have an existing dwelling or ruin?

Yes I know that the laws have changed.

The use of the land is agricultural and the need to build a house is of no importance.

Building a barn is not a problem!

If the 59 agreed to the sale, there would be no problem...... I bought a house in France for the price equal to around 11,000 pounds which needed 20 or 23 people to sign which they all did or gave power of attorney and sale went through ok. Why not contact a company specialising in agricultural land if thats what you want?

When we first came to Spain we were interesting in buying a plot of land, heard of a plot direct from owner for 20,000 Euros and arranged to view it the next day, when we met him before we even got to the plot he said the price had gone up to 26,000 which we thought was very odd and then when we got to the plot he said the price was now 36,000 (each time he was giving us the price in pesetas too just to confuse matters even more).

How stupid is that? - apparantly it's the way the Spanish work, instead of coming down they go up instead, if he had started at 36,000 we might have been interested still but because of the way he conducted it all we walked away.

Building a barn is not a problem!

Getting permission to build a barn can be an enormous problem. You still need a minimum amount of land (in this area 25,000 sq. mts.) and you will have to prove income from the land. Check it out!

That is a big IF!! And not what I was wanting to do!

But that was not my point really. The land is indivisa(sp) and as such the current owner CAN sell his % without a problem. The problem comes if I want to actaully DO anything with the land!!

Getting permission and building a barn isnt a problem.

I agree that there may be some limitations on land size but you certainly do not need to prove income from the land!!

This seems to be a bit of an urban myth. A barn is a barn NOT a house, although there are some who think that living in a luxury 'barn' is acceptable!!

Building a barn for the purpose they were intended at is relatively 'easy' by Spanish standards.

Provided you speak with the local council first of your plans AND submit a sensible project there whould not be a problem

Land which is owned 'proindivisa' is a nightmare. The percentage owned by each individual owner is not a geographical percentage (ie a little corner of the whole plot) but one of the plot as a whole.

Each owner owns a percentage share in the whole plot which is fine among members of a close knit family but is an absolute no-no where strangers are involved.

There many unsuspecting 'landowners' to whom this situation applies and they are totally unaware of it because the implications were skipped over when they appeared before the notary to carry out the transaction or they were mis-represented by their lawyer and because they have a title deed they think that everything is in order.

I agree. It is a complete mine field and the nightmare comes when you build something on your %

Every other part owner has the rights to use 'your' building!!

I find it hard to believe that there are "many unsuspecting 'landowners' to whom this situation applies".

It is the first thing that stands out a mile on a Nota Simple!!

Question to owner\seller "Why dont you own 100% of the land"??

Owner\seller "Dont know nuffink bout it gov" (In Spanish of course)

A supplementary Nota Simple kind of gives the game away, slightly!!

And the guy is still asking me if I want to buy it!!!!
