Legal speeding?
Can anyone clarify if on non-urban roads it is permitted to exceed a speed limit to overtake?

Re: Legal speeding?
Is this an urban myth or true? My son, who has taken the Spanish driving test, therefore has done the theoretical part, says it is permitted but I wouldn't take his word for it.
Re: Legal speeding?
Says you can on a new post on n322 site. Post about road signs and changes in the law re driving with a mobile. Believe it says you can go 20kph over when over taking
Re: Legal speeding?
I understand it is correct on single carriage way roads but not on dual carriage way or else you would get people driving at 140 KPH in other than the inside lane "because they were overtaking"

Re: Legal speeding?
it is on single lane roads. If not as Gerry says on dual you would say I was just overtaking a q of lorries officer.
Re: Legal speeding?
In the news today, speeding to overtake is now illegal. Using a phone is now 6 points loss and 500 euro fine up from 200 euro. That should stop alot of mobile phone offenders.
Re: Legal speeding?
This was in the news:: Other tougher measures to improve road safety have come in as well, including scrapping the rule that allowed the speed limit to be broken briefly on normal roads when overtaking.
Re: Legal speeding?
Effective from Jan 1st, 2021.
In any case, it's really not necessary to go above 120kph. Last week I drove from Cadiz to La Coruña. Cruise control most of the way, really helps to keep speed in check.

Re: Legal speeding?
I read somewhere that not wearing seatbelts is the 4 th biggest contributor to injuries.
It will be interesting to see if the new laws will be policed. I sometimes do a tick record of vehicles without seat belt worn or using tech. ( i have even seen folk using a laptop) two weeks ago, I saw a bloke texting whilst driving a quad bike.
Re: Legal speeding?
Drink, speed, seatbelts and mobiles are the big 4. I suppose the 5th is the cr+p Spanish drivers.

Re: Legal speeding?
That is hard. I first came across these really slow speed restrictions in London and they take a bit of getting used to especially in a hire car. When driving in Bilbao, I have to engage my speed limiter so as not to speed.

A reminder post about the new laws. Although some contradictions as per the norm as to when the 50 - 30 law comes in. Now or may.? Hope they are as strict on all the tail grating that will increase now due to people obeying the law

Re: Legal speeding?
The way I read it is that the law would be introduced on 1st January but not actually enforced until June.
Be prepared for much more hooting, shouting, fist waving and tail-gating if you try to comply with the new limits.

Transaltion from N322
" Personal Mobility Vehicles.
- Vehicles with one or more wheels, equipped with a single place, powered exclusively by electric motors, such as scooters and Segways will be regulated, the maximum speed will be between 6 and 25 km/h. Vehicles for people with reduced mobility such as wheelchairs are excluded.
- These may not be used on pavements and pedestrian areas, as well as on interurban roads, crossings, motorways and highways that pass-through towns, or in tunnels.
- They will have to comply with the rules of the road like other vehicles, so drivers may be subjected to the breathalyser test and headphones may not be used.
- These three measures will enter into force on January 2nd, 2021.
- In addition, these vehicles must have the corresponding certificates that certify that they comply with the technical requirements contemplated in the manual, two years after its publication.

Hola
For the speed limit change, it will not come into force until May to allow signs to be changed. And the speed limit may not be exceeded at any time.

The reform eliminates the possibility that cars and motorcycles may exceed the speed limits on conventional roads by 20 km / h when they pass other vehicles. The abolition of this measure, which had already been eliminated in the rest of the countries of the European Union, reinforces the message that the overtaking manoeuvre carries a risk of frontal collision
