Community insurance

Postby swerve » Thu Oct 10, 2024 9:22 pm

Our president wants to cancel our community insurance. Feels it's too expensive. Can anyone advise wether this can be done. Or is it a legal requirement in Andalusia.

Better idea would be to cancel your president.

I would strongly object if your President succeeded in cancelling Community insurance. It would leave the community members liable for any third party claims for damages caused by the community or its property. A few years ago I was President of an Urbanisation that was badly affected by a campo fire that spread into the urbanisation. The cost of restoring all the services, power, water, as well as cleaning up the coommon land after the fire would have left each homeowner a bill for over 20K per household if we hadnt had insurance.

Unfortunately nobody else wants to do the jobs. The president is also the secretary and the treasurer. I'm going to see how they vote. If they vote for cancelling can I denounce the president.

Thanks

That is a tricky one, I know there are steps that can be taken to remove a President if sufficient owners want to, but I an not sure about a Denuncia.
If I were you I would put your questions to a lawyer who is familier with the Horizontal Property Law and community problems.
Good luck.
